ARBITRATION NOTICE AND CLASS ACTION WAIVER: EXCEPT WHERE PROHIBITED AND EXCEPT AS SET OUT IN SECTION 16 (INCLUDING YOUR 30-DAY RIGHT TO OPT OUT), YOU AGREE THAT DISPUTES BETWEEN YOU AND BILD HEALTH WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION, AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

1. Medical disclaimer

Bild Health provides education, not medical advice. The application is not a medical device and does not diagnose, treat, cure, or prevent any condition. Protein targets, hydration targets, goal-weight ranges, and estimated medication levels are informational estimates derived from population-level models and the data you enter; they are not dosing instructions, and they may be inaccurate for you. Do not start, stop, or change a medication dose on the basis of the Services. Consult your prescriber for all medication decisions.

THE SERVICES ARE NOT FOR EMERGENCIES. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY.

2. Eligibility and acceptance

You must be 18 years of age or older and located in the United States to use the Services. By creating an account or using the Services, you accept these Terms of Use ("Terms"). Consents relating to health-data uses are collected separately in the application, not through this document; see the Privacy Policy.

3. Accounts

An account is optional for most of the Services: browsing the Site requires none, and the application can be used without one. An account is required for purchases and the signed-in account area on the Site, and certain features of the application — including cross-device sync, where offered — require one. You may register with an email address and credentials or through a supported third-party sign-in provider. You agree to provide accurate registration information, to maintain the confidentiality of your credentials, and to notify us promptly of any unauthorized use of your account. You are responsible for activity occurring under your account. You may delete your account at any time (on the Site, in your account page; on iOS, Settings → Manage My Data); deletion of your account and deletion of on-device data are separate actions, each described in the Privacy Policy.

4. The Services

Bild Health is a protocol instrument for people on GLP-1 medications: dose scheduling and logging; protein, water, and exercise tracking; results charting from data you provide or authorize; DEXA scan import; estimated medication levels computed from the doses you have logged (plus, if you were already on your medication when you joined, the start date and schedule you provided — see the Methodology page); and, where offered and enabled by you with the explicit consent described in the Privacy Policy, synchronization of your data across your signed-in devices and the website. We may add, modify, or discontinue features. If a change materially reduces a paid feature, the refund path for App Store purchases runs through Apple as described in Section 6, and for Site purchases through us.

5. Your device and your data

By default, health data you enter is stored on your device, and Bild Health retains no server copy of it. Unless you have enabled cross-device sync, we cannot recover or restore that data if you lose your device. Because your health entries are deliberately excluded from device backups for your protection, a device backup will not restore them: use Settings → Manage My Data → Prepare my export to keep your own copy, and store it somewhere you control. If you enable cross-device sync, the categories you consented to sync are stored on our servers and available on your other signed-in devices, as described in the Privacy Policy; categories you have not synced remain device-only and unrecoverable by us. You are responsible for the accuracy of the information you enter; estimates computed from inaccurate data will be inaccurate.

6. Subscriptions and billing

App Store purchases. On iOS, Bild Health Pro is an auto-renewing subscription purchased through Apple at the price and term shown in the App Store at the time of purchase. Payment is charged to your Apple account at confirmation. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period; your Apple account is charged for renewal within 24 hours before the period ends. Manage or cancel in Settings → Apple ID → Subscriptions; deleting the application does not cancel a subscription. A free trial, where offered, converts to a paid subscription unless cancelled before the trial ends, and unused trial time is forfeited on conversion to a paid plan. Billing and refunds for App Store purchases are handled by Apple under Apple's terms.

Google Play purchases. On Android, Bild Health Pro is an auto-renewing subscription purchased through Google Play at the price and term shown at the time of purchase. Payment is charged to your Google account at confirmation. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel in the Google Play Store app under Payments & subscriptions → Subscriptions; deleting the application does not cancel a subscription. A free trial, where offered, converts to a paid subscription unless cancelled before the trial ends. Billing and refunds for Google Play purchases are handled by Google under Google Play's terms.

Site purchases. Subscriptions purchased on bildhealth.com are billed by our payment processor at the price and term shown at checkout and renew automatically until cancelled. Manage or cancel through the billing portal in your account; cancellation takes effect at the end of the current billing period. Except where required by law, amounts paid are non-refundable.

A subscription purchased on any platform unlocks the same entitlement across the Services.

7. Your content and license

You own your data; these Terms transfer no ownership to us. You grant Bildbot Inc. a limited, non-exclusive license to host, process, display, and back up your content solely to operate and improve the Services for you. You further grant Bildbot Inc. the right to create and use de-identified and aggregated data derived from your content — data that can no longer reasonably identify you — for improving the Services, including testing, research, internal analytics, and product development and improvement, including, without limitation, the development and improvement of Bild Health's current and future artificial-intelligence and machine-learning algorithms and models.

Use of identifiable data for the training of artificial-intelligence or machine-learning models is governed by the Privacy Policy's Artificial Intelligence and Model Training section and requires the separate opt-in consent described there; this document does not grant, and cannot grant, that consent. The de-identified data grant in this Section 7 is not a grant of rights in identifiable data.

8. AI features

Certain features may be powered by machine learning ("AI Features"): content you submit to them is "Input," and what they produce is "Output." Outputs are educational estimates; they may be incomplete, outdated, or incorrect, and they are never medical advice or dosing instructions. You are responsible for evaluating Outputs before relying on them, and you assume sole responsibility for decisions made on the basis of them. The medical disclaimer in Section 1 applies to every Output. Data handling for AI Features, including training limitations and required consents, is set out in the Privacy Policy.

9. Affiliate links

The Services may recommend physical products (for example, smart scales) via outbound links. Some links are affiliate links: if you make a purchase, we may earn a commission at no additional cost to you. This is disclosed at the point of recommendation. Recommendations reflect our judgment of fit for the protocol, not commission size. Retailers receive no information about you from us, and their sites are governed by their own terms.

10. Acceptable use

You agree not to: use the Services in violation of law; reverse-engineer, scrape, or resell the Services; probe, disable, or circumvent security measures; access another user's account; present Output as medical advice to others; use the Services to develop a competing dataset, product, or model; or interfere with the operation of the Services or other users' use of them. We may suspend or terminate access for violations.

11. Intellectual property

The Services — including software, design, models, content, and trademarks — are owned by Bildbot Inc. or its licensors. Subject to these Terms, we grant you a personal, non-transferable, revocable license to use the application on devices that you own or control, in accordance with the terms of the marketplace from which you obtained it (the App Store for Apple devices; Google Play for Android devices). Feedback you provide may be used without restriction or obligation.

12. Third-party services

Apple Health, Health Connect, iCloud, Google services, BodySpec, and linked retailers are third-party services governed by their own terms, and we are not responsible for them. Connecting your BodySpec account is your instruction to that provider to share your scan data with the application.

13. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ESTIMATES ARE ACCURATE FOR YOU, THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DATA WILL NEVER BE LOST. SOME STATES DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BILDBOT INC. WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, OR HEALTH OUTCOMES, ARISING FROM OR RELATING TO THE SERVICES. OUR AGGREGATE LIABILITY IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND (B) $100. THESE LIMITS DO NOT APPLY WHERE PROHIBITED, AND NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.

15. Indemnification

To the extent permitted by law, you agree to indemnify Bildbot Inc. against third-party claims arising from your violation of these Terms or your misuse of the Services. This section does not apply to claims arising from our own breach of these Terms or violation of law.

16. Dispute resolution — binding arbitration and class waiver

Before initiating arbitration, contact legal@bildhealth.com with a description of the dispute so that we may attempt to resolve it informally. Any dispute arising out of or relating to these Terms or the Services that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, seated in Wilmington, Delaware, governed by the Federal Arbitration Act. Either party may elect small-claims court for qualifying claims. Class actions and class-wide arbitration are waived. If the class waiver is found unenforceable, this entire Section 16 is void.

Opt-out: You may opt out of this arbitration agreement by emailing legal@bildhealth.com with your name and the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out does not affect any other provision of these Terms.

17. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except that Section 16 is governed by the Federal Arbitration Act.

18. Termination

You may stop using the Services at any time. To remove your content, use Settings → Manage My Data → Delete all my data and delete your account; your health entries are excluded from device backups, so they are not left behind in one; non-health app preferences may persist in an existing device backup until that backup is replaced. Cancel any subscription separately, as described in Section 6. We may suspend or terminate access for violation of these Terms. Sections 1, 7 (de-identified data grant), 11, 13, 14, 15, 16, and 17 survive termination.

19. Marketplace-specific terms

These Terms are between you and Bildbot Inc., not Apple or Google. Neither Apple nor Google has any maintenance, support, warranty, or claims obligations with respect to the application. Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms with the right to enforce them with respect to copies of the application obtained from the App Store. You represent that you are not located in an embargoed country and are not on a U.S. restricted-parties list.

20. Changes to these Terms

We may modify these Terms at any time, without prior notice to you. The effective date at the top of this page identifies the most recent version, and modified Terms apply from the date of posting. Your continued use of the Services after the effective date constitutes acceptance of the modified Terms. A dispute is resolved under the version of these Terms in effect when the dispute arose.

21. Miscellaneous

These Terms, together with the Privacy Policy and the Consumer Health Data Privacy Policy, are the entire agreement between you and Bildbot Inc. regarding the Services. If any provision is found unenforceable, the remainder continues in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a corporate transaction as described in the Privacy Policy.
